regarding M-20 bond on stamp paper

bond Stamp paper was purchased on 18th December 2006 and the member filling the office joining date 17th December 2006 and witness signature are also there same date 17th December 2006. is it valid???

if yes then fine if no..where to complaint abt this ...

Yes it is valid, because validity of the stamp paper is 3 years from the date of issuance.

means record of purchase by a purchaser doen't make any sence then why maintain register for tht...if i m entereing in a contract i bought stamp on 15th n signed on 14th ...means i entered in contract on 14th...then what is the menas of 15th..purchasing date of stamp paper...how can it be possible before birth of stamp how can i sign tht...

Dear Priyank,

Your transaction is valid transaction. Document execution and stamping of the same document is different duties of the parties.

In your case, parties are entered in to agreement before stamping was done. Subsequent stamping is valid under Laws.

Stamp act provide you two months time to do the stamping of executed document.

Stamp paper does not invalidated your valid contract.

3 dates u can c on tht...

1. 06/12/ issued to govt. vendor
2. 18/12/ purchased by A
3. 17/12/ signed by A

wht is the stand of this doc. in court...pls explain...

The signing of the M-20 bond on the stamp paper with ante date is no doubt irregular.Since such execution is impossible, it can always be explained that the dating of the document was an inadvertant error. In my view the mistake is curable and the bond date can be corrected with due authentication, before the same is filed with the RCS.

thanx a lot Mr. Gupta...one more question to ask..total 9 persons signed tht bond...7 back dated n 2 on current date means on 18th ...now question raised when u come to know why u didn't correct tht mistake....n this same bond submitted to registar...with this mistake with some intention or just like tht...now in ths situation ...wht would be the condition in court...

What can be the intention? By ante dating the bond no special benefit accrues to the memebrs concerned. On the other hand by signing the bond they have sufficiently demonstrated their intention to comply with the Rules. The members concerned can alwys file an affidavit declaring the correct date of execution of the bond before the Registrar.
