Respected sir,
I am Raajsekhar from vizianagaram andhra pradesh,i hv got married with a girl in 2003 on nov 1st..and after my marriage i came to know that the girl got married before itself,and without taking a divorce from 1st husband she married me..and i came to know that she was married in jan 10th 2000.
and she has taken a divorce from 1st person in 2004 march..
i dont hv any proofs with me as she was hidden the papers..
how can i get those papers abt marrg n divorce frm the court..
coz almost 1 n half yr gone she left from my house..
and i didnt taken a single pie as dowry from her at the time of marrg,and now she was asking me to pay the mny for her gold..as she has kept the gold for her personal use at the gold shop..and the gold shop person is the proof and her parents has contated to the gold shop person regularly
and my dad passed away in nov 2010 and i intimated those people also but they dint hv min courtesy they didnt came and they didnt call me also
so how can i file a case on her..
pls do me the needful

You married in nov. 2003 and your wife got divorced from the 1st in 2004.
so, your marriage is void.

As you have no documentary proof in support of your version so merely oral saying shall not work in such matters. It shall be good if you file a petition under section 9 of HMA and I hope she shall engage same counsel as she might have engaged and then take him or his staff in confidence and obtain the papers of her earlier divorce. Once those papers come in your hand the you have to file a petition seeking declaration of your marriage as void ab initio.

Mr. Makkad is right. Unless you get copies of the divorce papers, there is no point in going for proceeding for declaration of marriage as void.

your marriage is VOID no doubt,but proof is the problem,Mr.Makkads' suggestions may work or may not work.
I add one more suggestion but with no guarantee that go to court you guess the divorce proceedings might have gone with,and check its institution register with help of a lawyers munshi ,may be you get it ,then apply for a copy and then proceed to do needful.i guess,wife might have filled divorce in the district of her parrent.

One more practical suggestion. Whether yours is love marriage or arranged marriage? If it is arranged marriage, at least some people would be aware about her first marriage and its details for divorce, though they would not have disclosed on their own. Their assistance and get the papers. Another source is her first husband. If you can ascertain his details, he may help you in procuring the papers.
