This query is : Resolved
I am a respondent in a writ petition. The Petitioner has given my old residence address to the High Court, and summons have been returned. I need to send written submission to the High Court by post as currently I stay out of Mumbai. What is the procedure?

you have to file the written submissions in court . engage a lawyer to appear on your behalf and file your reply

better you engage a lawyer and present your submissions whether oral or written through your counsel only.
let the procedure be followed properly and the requisite court fee be paid.

Affidavit in opposition is to be filed by affirmation engaging your counsel who will act on your behalf.

The only problem is due to the BJP support to the opponent i.e the Petitioner in this case, I am not getting a competent lawyer in Mumbai. Hence, this mess.

ridiculous . bombay high court does not go by political affiliations of parties . only on merits of the case

That should not be a problem, many lawyers are now equipped to handle these things over mail
If you want I can refer one.

There is no relevance of your old address with your defence of petition. If summons had been returned, how did you came to know about it?
There are various lawyers active in this forum. You can engage even either of them and political affiliations are not bar a all in professional matters.

My contact number was mentioned on the summons, and hence the local police station of the area wherein I lived earlier, contacted informing me that the summons were being returned to the High Court if I did not collect it by next day. I gave them my current address.
The writ petition is for quashing the chargesheet and subsequent criminal proceedings. I am a complainant in a criminal case.

you do need to engage a lawyer in high court, that would be a better way to watch the case.

The experts are missing out on one important point - I need a competent lawyer who can take political pressure. I have been threatened by my former lawyer as I refuse to settle the matter out of court and pay the accused extra money. And they are influencing other lawyers I get in touch with.

Agreed. But unfortunately, the police and the judiciary (especially the lower courts) are puppets in the hands of these politicians. To get the chargesheet filed in the court against the accused has taken almost 3 years.
