Is Employment Bond is legal / valid in India.

Can a Company make a Bond of particular period with a new candidate.

Dear Experts,
Supporting to above query, after expiry of such bond, the employee resign but still company is not issuing him (that employee) reliving letter or company force that employee to give them his own resignation letter which is totally under protest!!
what is the remedy in this case/ circumstances.
pls suggest!!

Dear Manoj,

Your query does not provide clear picture what actually you want to know, as on one hand you have stated the employee resign, but company not issuing relieving letter and on the other you have stated that the company force the employee to give resign. What does that mean, the employee resigns and even then the company forces him to resign?

IF ONE READS THE bond as AGREEMENT, THEY ARE.

YES IF THE PERIOD FALLS WITH IN AMBIT OF REASONABLE RESTRAINT AND IS FOUND NOT HIT BY
PROVISIONS OF section 27of the Indian contract Act.

The employee is not bound to sub,it resignation letter.
Moreover the employer can be sued both for breach of job contract, if any and for causing mental agony cum harassment.

The question of Manoj is employer is not relieving his employee who has resigned after completion of bond period.

In such case, employee can leave without any problem and can serve a legal notice followed by civil suit seeking his full and final settlement as relieving letter etc.
