Process for filing case under ni act by the company

Dear All,

I would like to know about, the process for filing case under NI act by the company. If any draft is avilable please share with me. if not kindly let me that the essential facter which need to be consider for filing the case.

cheque must have been issued to the company in respect of debt due and payable

cheque must have been dishonoured on presentation
legal notice must have been issued within 30 days

no payment made in reply to legal notice .

complaint must be filed by company within stipulated period

officer filing complaint on behalf of company must be duly authrosed to file complaint by board resolution or power of attorney must be issued in his favour

Please go through the sections 138 and 142 of the NI Act.

on complying the legal formalities you can file the complaint.

There is no separate draft for a company, a regular complaint format which is used by the individuals is sufficient.
