Bathroom water leakage from the above flat

I own a flat in Vasai and the bathroom of the flat above me has water leakage issues.
Initially the ceiling of my flat was wet, when we notified the above resident, he said that he had done repairs earlier and would not do any thing further.
The society says it is a matter between two members and they cannot do anything.
The situation is such bad not that the cieling of my entire bathroom passage and kitchen is wet. we also have a constant dripping for which we have to keep buckets to collect the water.
The foul smelling odour is also a big issue from the wet walls.
Please suggest what can be the next step of action that i could take
Is it the responsibility of the owner of the flat above me to fix it?

issue him a legal notice . if he fails to rectify leakages move cooperative court against said member . you can offer to pay 50%of cots of repairs .
