Filing of defamation &mdamages suit for naking false charges

(Querist) 19 September 2013 This query is : Resolved
I was prosecuted by the jurisdictional police under false charges of very serious nature made / filed by a nationalized bank, in which was however I was acquitted and subsequently the police through the State government appealed against the order of acquittal before the High Court which too was dismissed by the High Court about 9 months back.

Now whether I can initiate defamation case against the bank and claim suitable damages through initiating criminal case OR is it only through Damages Suit do I have to claim damages. Please clarify.

You have been acquitted because the charges against you are not proved OR COULD NOT BE PROVED.

IT DOES NOT MEAN THAT THE SAME ARE PROVED FALSE HENCE NO ACTION POSSIBLE.
