138 cases

dear members i need ur expert advise on a 138 matter my quer is:
that "is 138 case maintainable if cheque has been issued after closure of the account that is the account was already closed in say march and the cheque was issued from that account in july"
any citations would be helpful....
will it be a 420 case only or 138 also can be filed?

Yes, the case is maintainable unless the debt is long closed.

criminal complaint is maintainable . when you close account you are supposed to return the blank cheque books lying in your possession . if cheque has been issued in july after closure of account complaint under section 138 is maintainable
