Whether Petitioner/Lawyer can be booked ?

Querist : Anonymous (Querist) 14 July 2010 This query is : Resolved
If any Petitioner or Advocate picks up the pages of torned petition/paper book which lies unattended outside the Court's Office. Can it be booked under the provisions of the IPC? Please inform under what sections?
Raj Kumar Makkad (Expert) 14 July 2010
Why an advocate, anyone can pick up torn papers and mere picking outside court campus/office is not an offence so no question arises to initiate any legal action if the facts given in the query are true.
Daksh (Expert) 14 July 2010
Dear Anonymous,

No offence is made out on the basis of facts stated by you.

YOU MAY KINDLY NOTE THAT MISUSE OF LAW PROVISIONS AGAINST INNOCENT PERSONS IS NOT ADVISIBLE.

UNLESS SUFFICIENT EVIDENCE IS THERE CASE CAN NOT BE PROVED IN COURT AND KINDLY DO NOT INVITE TROUBLE AS THERE ARE CHANCES OF CROSS COMPLAINT AND CASE OF DEFAMATION TO BE FILED AGAINST YOU ,DUE TO FALSE CASE FILED BY YOU.PLEASE NOTE.

GOOD LUCK.
G. ARAVINTHAN (Expert) 20 July 2010
Though the document is a public one, it was under custody of nobody. Hence no offence
