No of Defendants

Querist : Anonymous (Querist) 01 January 2011 This query is : Resolved
Learned Advocates,

A land has been encroached by two different neighboring persons, so can all be made defendant in the same civil suit for recovery of possession. Or will have to file different suit for them separately?
Please answer.

Thanks to all.
G. ARAVINTHAN (Expert) 01 January 2011
property is one and the same, hence one suit is sufficient

Single suit enough.. You can add both parties as defendants..

Agree with the above. Take care of the narratives.

you can join the different cause actions into one and file a single suit with different reliefs against different persons

One has encroached in March 2010 and another has in oct 2010, I ignore the encroachment by first one and this encouraged the 2nd one and has encroached a substantial land.
here the property is same and encroahers too are neighbor themselves and both have encroached east portion of the land side by side.
So shall i mention different cause of action?
Thanks
Advocate. Arunagiri (Expert) 02 January 2011
Even though it is two different cause of action, the encroachment is on the same property within 7 months. So, you can file a single suit.
Kirti Kar Tripathi (Expert) 02 January 2011
agree with experts, one suit is sufficient.
