I have been trying hard to know as to request made to police for its intervention in locating their kin who was lured by some false promises but did not return back would be treated as Cognizable report to initiate investigation by police or it would be non-cognizable to seek permission of area magistrate for police to act?The report/request lodged was not registered under any crime no and section of IPC.

File a petition u0s 156930crpc n the court of the Maiiistrate statng all the allegations. The Magistrate would then diirect the Police concerned to cause necessary investigation.

Sir,We are the accused against whom an request was submitted to police but it was not FIR because no crime no. and no any offence under IPC and after four days police took statement of complainant and after the statement, converted that request into FIR u/s 364 IPC and started fabricating false witnesses,fabricated evidences but since our defence lawyer was very weak, we lost the case and we are all novice about the law.Any enlightenment please.
