co-operative housing societies

(Querist) 15 April 2011 This query is : Resolved
I have obtained the registered byelaws of my society through RTI. I wish to know that when a resolution is passed and registered , does it become a byelaw? or is it considered as another rule to be followed. and /or what is the difference between byelaws and resolutions. And if they are different how can i get a copy of these resolutions ?

Unless the general body by prescribed majority vote approves to make amendment in the existing belaws of the society to add the provisions of the resolution that cannot become part of the byelaws.

Resolutions, however, are general decisions of the executive or the general body to be complied with as instructions to be carried out to conduct the business related to the resolution.

so if the latest byelaws that i have obtained dont include the resolutions copy given by society to me , it wont have any legal standing?

My society has been passing resolutions that they can cut water connections of owners keeping paying guests?

Resolutions passed by the executive have to be finally approved by the General body. Resolutions passed by the general body are quite legal. If not got passed by general body, you can challenge the same at first in the general body and thereafter, even if passed by the general body also but are unethical in nature, can be challenged in the court of law.
