Tenant Rights

Querist : Anonymous (Querist) 24 April 2011 This query is : Resolved
Hi,

I have been living in a society in E Delhi. When I came to this society, the first question that I asked the land lord and the manager when I signed the tripartite is how is additional car parking allowed. I was told that they charge Rs. 100 per month for extra parking.

From september, the society has enforced a previous provision and said that owners are allowed second car and not tenants. They have told me that I wold be asked to pay Rs. 100 per day.

My question is we also pay the maintenance and other dues. How can there be differential rules for owners and tenants.

Is it legally enforceable.
What should I do.

File a suit for injunction.

its not a matter of different parameters....its a matter of agreement between the parties, the owner might have got the parking for free, but if he is intending to generate more returns from his property then there is nothing illegal in it....landlord has invested in the property to get healthy return out of it....the JANSEVA days are gone...

you can not dictate terms to the landlord, a tenant does not become the owner of the property.

its better to maintain healthy relationship with the landlord, its advisable not to make a dispute because of Rs.100/- extra charge.

The question is not that the land lord wants more money. It is the society which has implemented a new rule that landlords who are residing can park 2 cars and people who are tenants are eligible for only one parking.

If tenants park more than one car, they will be charged Rs. 3000/ per month etc.

My question was can there be differential treatment between landlord who are residing in a society and tenants?

Thanks in advance.
