Yes.. If there is no will favour to your father mean you can claim your partition.. Just issue a legal notice to your father for partition claiming.. If he failed mean just file a partition suit..

Even without your knowledge your father sold the property mean, after the date of knowledge you can challenge that sale as null and void.. Just put your eyes on all activities..

You mean if he decides to sell then i can claim the sale as null and void because he cant sell my share?
Also he has to name a nominee for the flat in the meantime.Can he name my cousin(Son of my deceased aunt/fathers sister) as a nominee?Also what legal rights would my cousin have as he does not even share our family name?

Regards of his share he can do whatever.. But don't worry about your share..

You mean he can insist on selling the flat and claim his share?
If both of us have a share then wont there be a conflict if one of us wants to sell and the other does not?I do not currently want the flat sold as i live in it.
