Under SARFEASI issued Sale Certificate to the Auction Purchaser. Meanwhile the aggrived party filed Writ Petition and Appeal before DRT Court. Now the Writ Petition and Appeal are dismissed. The Sale Certificate is 3 years Old.
My Question is 1) The Sale Certificate issued holds good for Registration. or 2) Fresh Sale Certificate to be issued for Registration

Since no fresh sale took place, the original sale certificate is enough.

The Sub-Registrar refused to register the Sale Certificate, Since not presented with 8 months from the date of issue.

Give a covering letter explaining why the same could not be registered earlier. Also attach a copy of the order of the High Court in the Writ petition. In spite of that, if the Sub-Registrar does not register, then file a writ petition before the High Court seeking a writ of mandamus.

Agree with mr.ramchandran. Also produce your earlier sale certificate along with the copy of the disposal order of the appeal and w.p. In that order may be stated anything about the confirmation of your sale certificate. Its will help you..
