I am a bachelor and have joined a PSU few months back. The PSU is at its inception stage and hence no quarters are available for its employees. My employer has provided me accommodation in bachelors’ hostel at present which is twin sharing basis. Now I wish to take a rented house outside for personal reasons, but my employer states that I will not be entitled for HRA even if I take a rented house. As per my grade, I am entitled of office quarters which are not available at present. Kindly clarify if at all my employer can deprive me of HRA without providing me office accommodation as per my entitlement. Can you please provide me the rules/ laws under with I can claim my entitled HRA.

SIR, 1.YOU ARE WORKING WITH PSU.SO THEY HAVE THEIR SERVICE REGULATIONS .YOU MAY REFER TO YOUR JOB OFFER AND APPOINTMENT LETTER .IN CASE REGARDING HOUSE RENT ANY SPECIFIC PROVISION IS THERE THEN YOU FOLLOW THE SAME. 2.YOU MAY TAKE THE HOUSE ON RENT AND INFORM THE EMPLOYER THAT AS NO ACCOMMODATION AS PER THE EMPLOYMENT CONTRACT IS PROVIDED HENCE CLAIM THE HRA. 3BUT KINDLY GIVE PRIOR INTIMATION THE OFFICE AND THEN ACT ACCORDINGLY .GOOD LUCK.

pls give information regarding ur department because each departmnet has own rules about hra so in my sence you also need to departmental inquiry regarding this matter

Mr Abhay:The PSU where I am working comes under Ministry of Chemicals & Fertilizers. I think (correct me if I am wrong) my employer will follow the rules of Department of Public Enterprise(DPE).
Mr Sawant: The PSU is at its nascent stage, hence Service regulations are yet to be formulated for many issues which is actually the root of all the confusion.
The HR dept is interpreting that "A bachelor will not get HRA as bachelors' hostel accommodation is being provided." But due to some personal reason, if a employee decides to stay in rented accommodation will he/she not be entitled for HRA? Please guide with proper clarification and the rules guiding HRA.

HRA is payable by an organization only when the organization did not provide any accommodation. If the organization provides the accommodation, but the employee refuses to take up the accommodation for whatsoever reason, then the organization is not liable to pay the HRA.
