My dad( alive ) has given a house as gift where my mom and me are the joint owners. Now my mom wants to transfer her share also to me. whereby I will be the Singe owner of that house. I have a deceased brother and his two daughters want a share in this house from my mom share. But my mom wants to give it to me only. Will there be any issue if my mom transfers her share to me as well.

If you are a hindu by religion then your mother is an absolute owner of the property by amendment vide 2005 she can dispose the property anyway.

If my father forces my mom to give her share to his daughter in law and her kids. What can my mother do in this case..can she still give me her share as she wished before. Why i am asking is the share of my mom is given by my dad.

The property received by your mother is gifted property by her husband. And she is absolute owner . Its upto your mother decision now what can be done.

Please don't mind, the question arises, why do you want to deprive of the share of property to the family of your deceased brother? In my views, if your mother is rational, she should transfer her share to the family of her deceased son, while you are already enjoying equal share in the property of your father.

Well..my deceased brother family has already gotten a much more share than me including some hard cash...however they are expecting more which my mom is against. if the question of justice and equity arises..i got around 20% percent share and my brother family got 80%.

My dad is living with my step mom and deserted my mom long back..without any divorce..after i fought for my mom..he gave half share of my property..which my mom wants to give back to me..
