Dear Expert,
I am looking forward to buy a builder flat with Home Loan in Mahavir enclave. But my problem is that builder had not seek for MCD MAP Approval for the same building.
Now i need below suggestions
1. is the building map can be sanctioned after its constructions done?
2. Is there any law regarding only floor approval plan in Propety Law?
3. If not, than should i buy that property?
Please provide your suggestions.

you have stated that you are desireous of buying falt with home loan .
please note that no bank will sanction you loan unless builder has sanctioned plans and building has occupation certificate issued by local authority . sanction of building plans is prerequsite for begining construction .

Ajay, Thanks for your reply.
I agree to your point that majority bank (i.e. private banks) are not apporving home loan without MCD sanction plan. However nationalized banks are approving loan in most of the delhi without MCd approval.
So my query remains the same is it safe to buy a Registered anf freehold floor without MCD sacntion plan.

If no dispute arises later on then no problem but you cannot predict future. So without MCD plan a Bank Cannot and has no authority to sanction loan.

Ok, please advice what's the worst can happen in buying such a flat. As the property is registered, what the worst action MCD can take again such building.

Moreover, after going through the internet, i found out that this colony i.e. mahavir enclave is MCD regularized....so now whats the risk in buying a floor there?

Mr. Gagandeep,
You ask what the worst can happen in buying such a flat? My answer, the worst thing that can happen is MCD can demolish the building. In that event, your hard earned money would go a waste.
Except this, nothing. (My answer is strictly confined to your above query only).

The problem is that 90% houses or builder floor in delhi are not having MCD sacntion plan, then where should one buy a flat?
Moreover when land is registered and freehold, then on what basis MCD will demolish the building?
Can i apply for MCD sanction after buying that flat?
