(Querist) 16 August 2011 This query is : Resolved 
i thank u sir for ur clarification. (suppose wife getting the property from her father as a gift deed, on this property is there any rights for her husband) in this case we r planned to construct a house so, we apply for lic home loans (LIC HFL). in this case they could done all the leagal and valuation and send the sanction letter with out sing by intimationg the loan eligibility and processing fees. we already pay the amount according to that letter. after complition of certain work we apply for first cheque disbersement but at this time they told that due to above reasion i.e in bracket one they stop the loan and told that processing fee (for leagal,valuation) also not refundable.
so in situation what we can do for getting loan or what amount we pay towords the processing fee. send ur reply as early as possible

please obtain the objections raised by housing finance company in writing . in case you are in position to remove the legal impediments do so .the amount paid towards processing fees wont be refunded to you in case loan is not disbursed due to defect in title to the property

A HUSBAND HAS NO RIGHT OVER PROPERTY OF HIS WIFE DURING HER LIFE TIME CONSEQUENTLY IF ANY LOAN HAS TO BE TAKEN FOR INNOVATION OR RECONSTRUCTION OF THAT VERY PROPERTY INSTITUTIONS WILL PREFER TO GIVE LOAN TO WIFE AS PRINCIPAL BORROWER AND WOULD DECLINE TO TREAT HUSBAND AS PRINCIPAL BORROWER FOR SUCH A PROPERTY.
