Problem relating to company name

(Querist) 20 August 2011 This query is : Resolved
sir, we have recently incorporated a company in the name of true value promoters successfully. Now we want to know whether any one can file a suit against us as the name resembles some companies. we have got the certificate of incorporation in this regard

Hold tight; if the Registrar of Companies has got you registered, the other copanies should not have any objection. Mere similarity in name does not attract the provisions of the the laws relating to Intellectual Properties, unless a malicious intension is categorically shown.

in my view under companies act once roc grants registration cert of incorpoation of comany resembeling name of other companies unless some malafides material on record with complaint newly incorporated comapany need not worry any ipr provisions &it's violation
Advocate. Arunagiri (Expert) 21 August 2011
The ROC will allot you the name, which is not similar to any other company name.

But, if any body having a similar name can object, may go to the court.
