(Querist) 07 September 2011 This query is : Resolved 
I was trapped in false 498-A, 323, 406 & 506 after marriage was lasted for 7years 3 months and judges are against me as my wife and her family are in Judiciary. I have applied for Divorce on Mental Cruelty Ground. Judges has threathned me for penalty. To show his power he will not show any mercy towards me and my childrens.I wish to ask what is maximum penalty under above IPC a Judge can order as judge is aware of all the facts.

i recall a similar query was posted some time back albeit in another way.

however u/s 498A the maximum punishment could be as it reads"shall be pun­ished with imprisonment for a term which may extend to three years and shall also be liable to fine"
3 years+fine.

And u/s 323 as it reads"punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both."
1year or fine maximum1k or both.

And u/s406 as it reads"shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both."
3years or fine or both.

And u/s 506 as it reads " shall be punished with imprison­ment of either description for a term which may extend to two years, or with fine, or with both;"

2years or fine or both.

Dont be penic.A judge or a magistrate must follow the law and must act judiciously. if a Jaudge or a Magistrate passes any order illigally, you may file a revision petition or appeal agaist such order or Judgement. Each and every order passed by a Judge or a magistrate must be Judicious, even when a Court excercise its discritionary powers, the discrition must be judicious.
