Cyber law

(Querist) 13 October 2011 This query is : Resolved
A person on social networking site meets another person who poses to be a 20 year old woman from UK. She invites him for cam chat and poses nude on cam and then asks him to start his cam and pose nude. The man poses nude too. The person on other side records this cam transmission and threatens the man with complaining under Cyber Law for pornography. Is the man liable for arrest if a complaint is lodged by the said person?
What are the provisions under Cyber law for the same?

Had He recorded the voice chat or written chat of the transaction? This will help the person to get relief.

The advent of communication has enabled advanced crimes and the innocent are dragged in for ride.In your case,if complaint is made, she will also fall in if the chat and video is replayed from the server. If your version that you were prompted to expose your self to her call, the adjudicating authority or the trial court as the case may be may dismiss the complaint. You may also prefer a complaint about the behaviour of the lady for using the cyber space for illegal activity so that the cyber crime can investigate the encrypted data while examining the server.

Thank u all experts Sirs.
The person has saved the written chat communication.
Is it okay for the person himself to go to police and give all the details on his own alongwith the machine that was used for the chat?
Also, in such situation, will the person still be arrested?
Arun Kumar Bhagat (Expert) 14 October 2011
No, need to go to Police Station.
