Save from 498a

Dear Sir,
I want to know that how i can save my family from false 498a. My wife was separated from me last 4 months. she now stay with her father. His father thread our family for 498a cases and demand Gifted items. I think my wife suffer from dependent personality disorder. Therefore, her father want to destroy my life.
Please Suggest me how to save myself and my family for harassment

if your wife is suffering from mentally condition then you can file divorce petition and you can also file a application for anticipatory bail. i will suggest you engage a lawyer.

Do not do anything in haste.Negotiate with father in law and make him agree for mutual divorce. Give back them the gifted item otherwise in case of litigation more than the value of gifted items shall be spent coupled with all sorts of harassment.

if you return the gift items than it must be written down and accepted by the other party and if this is not done than your wife may file for the recovery of the dowry articles and it will be difficult for you to solve that dispute and in this regard you will be in more trouble. so settle the dispute mutually.

You did not mention whether the complaint us 498A IPC is already lodged or not.

If yea then abscond immediately and apply for Anticipatory Bail.

To your good fortune the Calcutta is still liberal while declining with anticipatory bail in 498A matters.

let me tell you this straight, that no magic formula has been found to evade filing of 498-a. The day I find this formula, I would be a rich man.

However, you can take precautions as suggested by experts.

If burning train of 498 is running you need to rescue your self but if you anticipate only and want a way out that no short circuit
is caused Kapoor rightly says there is no magic formula to stop an accident as it is caused in situations beyond our control.

Gifts should be returned only after due execution of reliable receiving evidence of receipt .

divorce can be sought on the ground mentioned by you.
