Country vacation fraud

(Querist) 23 November 2011 This query is : Resolved
Dear Sir/Madam

I was contacted on 22.11.2011 stating that I got a gift voucher and that can be collected by bring my spouse. This is because I had filled the gift coupon Central Mall in Bangalore Sarjapur Road. Once I went there I was asked to listen a presentation for 45 minutes. This was relating to vacation travels. Its totally brain washing session. At the end of the session I paid 55,000 full payment. After coming home I found that this was fraud and many many people had suffered at their hands. We called them after 1 hour to cancel the agreement but they refused to do the same. This confirms me that whatever review I had read in net is true. I want to know is there any way to recover the money back. And more importantly need to stop this as so many people are suffering from this.

Thanks,
Balaji

You did not give the details as to how you suffered after paying Rs 55,000-.
The mere non satisfaction of deal after you accept it may not be a fraud or deficiency of service.

So if you give details of your loss or sufferings then only appropriate rememdy could be provided.

on the ground of misrepresentation, you can cancel deal.

Public Awareness helps a lot.
This tricks going on for over 20 years
They call to collect ur gift,
keep u waiting in a surrounding created , that hypnotist you, especially women
u invest & loose.

I know lots of people lost Lakhs.
They carry on these series of act legally, and u have to end it in Q at civil court for years to get a small left over portion.

No Law to prevent Marketting

for the time being atleast serve them with a legal notice.

certainly Civil Action follows in you case.

I agree with Mr. Shroff that there is no law to prevent such kind of marketing in India but you need not to bend...take an action.

how you made payment was it by cash or cheque?

did you obtain any receipt ?

Balaji (Querist) 23 November 2011
Thanks for such a swift response.

I paid this yesterday night and after checking in the net I found they are cheating and immediately called within an hour to cancel this.
But they reponded that once it is done cant be cancelled. First I want to make sure that it happened only yesterday and came to know it is fraud or not providing good service through net. (Still need to experince whether they cheated or not)
I asked them to clarify why there are such a bad reviews in the net. They said everything is rectified now and and they still promisied that I will provide all that they promised.

I paid the amount through credit card and hance no way of blocking the amount also. (Actually I tired to block the amount)
They didn’t provide a receipt but they mention the amount that I paid in the agreement and I signed that agreement.
And in the agreement too they had mentioned that money will not be refundable and also this agreement can't be cancelled.

As Mr. Shroff said it was damn good marketing (from their side :)
We were invited to collect a gift and they didn’t mention that they are calling from Country Vacation. They provided landmark near to that CountryClub.
Once we visited they brainwashed (Called marketing). Actually I was tired of working and didn’t think of too much about it and never suspected. They showed the agreement only after I made the payment. My wife was suspicious but somehow they managed to get signed. I still have to re-read it carefully.

"All I want is to cancel this. Or it can be cancelled if I was getting poor service or suffered through them?"

I feel so bad that after so many reviews in the net about them, that we cant to anything.

I filled the gift coupon in Mall near to my place, All I can do is warn the ppl who is filling whenever I visit this mall.

Thanks,
Balaji

If you satisfy the conditions as described by Shroff then definitely you have been defrauded so file a FIR under section 420 IPC against all such persons involved in this crime.

Till we would seek free lunches which are never there we shall make ourselves vulnerable the way YOU got caught yourself in fishy nets.

You are blaming them too much without thinking about your own rationale which visited to collect "FREE GIFT".Should not one apply one's own mind when even very near and dears are unable in exchanging gifts in this inflationary trend;, for what any stranger would distribute gift that too to masses while even Bill Gate or Barren Buffet COULD NOT FOUND themselves competent in this area.

People blame cheaters but i blame victims.
Actually it is GREED of VICTIMS UPON WHICH
A CHEATER PLAYS.

HAVE YOU HEARD OF A RULE"CAVEAT EMPTOR"the principle that the seller of a product cannot be held responsible for its quality unless it is guaranteed in a warranty.

Now you should wait for time of performance
as if you desire to rescind it on the ground of fraud, you need to file a suit to declare the contract void showing particulars of fraud against you in person and the opinions on net is not going to let you sail smoothly. In addition have 50k more to contest the suit out of which 10k may go toward's court fees and another 10-20k towards other expenditures including lawyers fees;then rest in your waiting calls. Then time you shall have to invest for attending courts'dates and depriving your opportunity to earn. These are the great factors one should calculate in mind before taking a decision to file any suit more particularly in money matters.

FIR IF ANY SHOULD BE FILLED BY MASSES ONLY THEN ANY POLICE ACTION WOULD BE POSSIBLE UNDER PRESSURE OR ELSE THEY WOULD BE RELACTENT TO ACT.

THE NEXT REMEDY MAY BE FORUM IF THEY FAIL TO KEEP UP THE PROMISE UNDERTAKEN BY DUE DATE.

You may also go collectively before High Court and may pray to direct police authorities to establish a special cell to investigate and book such elements who play with the hard earned money of innocent public.
