Misconduct

i have 2 qustions:

1. what constitute gross misconduct?

2. how the competent authority ( govt department) decide to award major or minor penalty ? what are the things he takes into account ?

About query (1), there are several types of acts personal conduct stipulated for a Government servant to observe. Any undesirable act not conforming to such conduct as well as irregularities committed against procedural rules of his organisation, can be treated as misconduct on his part. Grave misconduct denotes the very serious nature of misconduct. Types of personal conduct can be seen by reading book on Conduct Rules prescribed by the concerned Government under which he is working.

About query (2) Seriousness of misconduct is the criteria to award major or minor penalty, which only the disciplinary authority decides. The more serious is the offence, the penalty would of major category. Lesser serious offence can attract minor penalty.

I do agree with M.Dhingra. Like to add that before inflicting any punishment, the DA has to follow the procedures as per CCS (CCA) Rules if the Govt servent is a central Got. employee or the state CCA if he is a state govt employee.
