when the CA passes the order to pay the amount of gratuity, Procedure is this that the CA controlling Authority on application of the applicant issue a recovery certificate against the employer to the District Collector but in the officer of the DC matter is being kept pending for more than one year ? what i can do for the matter expedited and the persons who are committing mistake my be penalized ? for the negligence of recovery authority ?

Mr. suresh ,you can get the answer under right to information act from the distt collector and expedite the same.

File a writ petition against the collector as contesting respondent and the controlling authority under PG Act as non-contesting respondent. In the prayer in addition to the recovery and payment of the amount prayer, one other prayer has also to be included to pay the penal interest on the said amount, which should be recoverable from erring (most probably corrupt) official.
