Non bonafide member

(Querist) 03 January 2012 This query is : Resolved
Sir, My society is registered society in mumbai. Which was redeveloped in 2009. My query is , our MC called for three meetings for electing new MC. But only one name came forward to accept the post in MC. Other people are asking me to take a post of treasurer. I am a non bonafide member. flat is in name of my mother, however, we have submitted a ltr signed by my mother that she allows me to take part in society meeting etc etc. My mother do not stay with me. I want to know can a Non-Bonafide member become part of MC?. If yes, what should he take care of? In case, no one comes forward to manage society what shall one do??

Depends on the by laws of your society.
Generally, a non-bonafide member cannot be a memmber of managing committee.

1)no you cannot be a treasurer of the society . you are not a member or associate member .

2) if society has on your mother application accepted you as an associate member then you can be a office bearer

3) if no one comes forward administrator willbe appointed

As Shri Ajay Sethi suggested,

Handover the society management to the ADMINISTRATOR.

You can become an associated member on the basis of application of your mother and then can contest the election and can hold the office of the society as desired.

Dear Mr. Sethi,
how can be Administrator? One among us or will be person from outside?
ajay sethi (Expert) 10 January 2012
registrar will appoint adminstrator . it will involve unnecessary expenses
Raj Kumar Makkad (Expert) 15 January 2012
Even Joint Registrar has power to appoint Administrator if he feels that society has failed to perform its duties and his intervention is necessary.
SAA_Bombay (Querist) 08 March 2012
