Partition suit

(Querist) 12 January 2012 This query is : Resolved
An advocate files a partition suit on behalf of his clients. Is it necessary to enclose the Legal Heir certificate in support of the suit or can he simply file the suit without enclosing the Legal Heir certificate ?
Devajyoti Barman (Expert) 12 January 2012
If there is possibility of dispute with regard to tile over the suit property then it is advisable to file the copy at the time of filing the suit.

Else to file a suit document in support of the same may not be filed.
Pradeep Rohra (Expert) 12 January 2012
Yes it is necessary to enclose the legal heirs certificate to avoid disputes in future.
Raj Kumar Makkad (Expert) 12 January 2012
It depends upon the fact of the case whether to enclose it or whether to suppress it.
Deepak Nair (Expert) 13 January 2012
It is better to file the legal heir certificate so as to avoid any complications.
