In mutual consent divorce filed in district court delhi ,can period of six months be waived off now ? If yes,how?

Dear Neelam
no, it can not be waive off, when both of you were ready to divorce then why you filed MCD, you should filed a normal divorce case, it is possible to get divorce within six months.

no , court want to confirm, your decision is pakka? can stand 6 months. Quick divorce is harmful
it is for ur benefit that court ask u to wait for 6 months.

No. It is not possible to waive that mandatory period.

Only SC can waive this period under its powers of Article 142.

Can one apply to SC for the same if couple have been living separately since 2.5 yr or supreme court has restricted it to special cases?

There are several supreme court judgments on the point this and that way both but where it has been of view that a clear statute should not be offended by court is the correct view.

Well, I don't think, it would help, the SC has rarely intervened in the matter and the whole process at SC takes upto 3-4 months anyways.
