Suggestion of dv case

Respectable all,

I am a mother of Respondent,wife of my son

by way of manupulation and other things dragged the matter of interim in session court for past one and a half year finally ordered.

my query: when we can file application of 340 crpc , can we file immediately in trial court,or waitfor submittion- all allegations are put mere to harass and to extract money nothing more than that.

one more query: if complaint says she was absent on so and so date but her own submitted document in support of complaint says that she was present that day and that time. How court it taking such allegations which is cleared by her own submitted Document,

whether it comes under Perjury or self clear allegation

Dear Shusila Modi
You can file a complaint u/s 340 Crpc at any time of the proceedings, if you have strong proof in your favor, you can file an application for discharge u/s 245 Crpc.

Application u/s 340 Cr.P.C can be filed at any stage, but application u/s 245 for discharge is not comprehensive.

But how merely this can be a ground for filing CrPC 340?

Anyways it can be filed anytime during the proceeding is correct.
