Transfer of property

My father & his sister is dead. My Grandmother is also dead. Recently
my grandfather expired leaving behind his WILL for property into my
name only.
So what will be the procedure to transfer the property to my Name?
Can anyone else in the Family claim the property specially from my
Father's dead sister side?

You have to prove WILL, get probate &Letter of Adm,

Ans: If self acquired by Grandfather, no one can claim.

If the property is self acquired property of your grand father - then his will stands fine. File a Probate petition to get the will certified and put into action. Other paternal heirs of grandfather have no right.

If the property in the hands of your grandfather was ancestral then he could not have made will in your favour and the same can be got set aside from any other legal heirs of your grandfather but if the same was his self acquired then there is no problem.

Who is the owner of the property how does the death of your father and your sister is related to the property? Need more inputs to guide you properly. Is the property is owned and acquired by your grandmother by her self acquired funds then no one can challenge the will.

Hi Eperts,
First of all thats for your valuable answers. The property is in selft acquired one. My grandfather's daughter, wife & son are all expired.
Now I need to know the exact process that I need to follow to tranfer the property from my grandfather's registered WILL to my Name without any Public Notice. Is that possible?

get probate . where is the property? if it is mumbai you need to obtain probate from bombay high court

The property is a HUDA property. What all requires to get Probate. Please can you guide me the detailed process & what all documents I need to get the Probate?

you need to make application to court for probate . pay court fees applicable . affidavit of witness es to will . contact a local lawyer
