My wife left my home since last 12 month. She not wish to come back to my home but my in laws forced her to come to my home. Me and my parents also not wish to keep this relationship and don’t want her back. Social consular also recommended that couple can’t stay together. But in laws don’t agreed. I have asked consular about the report that she don’t want to come to my home and in laws forced her for the same. They said that they will not provide me the report but if on court order they will be present Report in court only.
She has just file Maintenance case 125 against me. I fainted if she is earning 12000 k (half of my salary 25000 K).
From 25000 K I’m paying 15000 for loans and rest 10000 for other expenses like my parents medicines and sisters education/ Building maintenance of 1000/ My un avoidable Mutual funds premium of 2000 per month. I hardly can save 1000 every month. How should I pay her for maintenance?
Beside this she is staying in her parent’s home and no expenses. His father has 2 flats in same city on rent. Her three brothers have their own flats.
Now they are going to file case police cases against me. Should I file NC (Non Cognizable) to local police about their threatening?
How should she claim for maintenance?
Will it be helpful for me in further police cases?
They wish to harassed me mentally & financially only.
I have not asked divorce yet but I wish to But my legal advisor suggest me to wait for their notic ? Should I trust on him and wait or file Divorce case?

: Ans: YES.
Her brother/mother is not agreed for any divorce. My Wife is M.Sc Chemical & currently doing job on 1oooo/- pm.
SO DO NOT PAY 12L
File Div after your Limitation gets over u married 1 1/2 yr bk. So Wait.
Only issue notice that you are demanding 12L alimony . or threatened me to file 498, dv , false charges of 326 etc at Kalcutta, ad harass me travelling from Jamshedpur to Calcutta, and in fact you deserted me.
That will protect you, and add in your evidence.
She cannot claim any maintenance as earning over 10k salary.Keep proof ready wth you.

agree with shroff. since your wife is earning rs 12,000 amonth and she can maintain herself she would not be netitiled to maintenace . have patience

I’m suffering lot in my work place due to depression. Under apprehension to be fire. I’m still try to concentrate on work. But Who know what will happened ….
Thought come in mind that either stay here with unemployment Or runaway from country.
So I thought to go to abroad to earn money to throw in my FIL mouth. That’s why I tried with some local consultant to travel to Gulf Countries for job. My lots friends are earning lot there. They are no skilled employee like me (Chemical Engg) But earned equal or few more than me .
But came to know that if I runaway from country, they can file LOC (Look for Circular) and I will never come back to my own country in future. My FIL will file cases against my poor nature parents.
Still no 498 cases on me so I can get Police clearance certificate (PCC) for 1 year validity easily. Which required to process visa to traveled to abroad.
I’m in puzzled what to do ??? Stay here OR at least opt Gulf country visa and fight cases for few months then go abroad?

Don't think about leaving the country until your family matters are sorted out. Otherwise, your parents may have to bear the brunt in your absence and in that case your depression may get enhanced, while foreign would expect you work like a slave, i.e., dual pressure on you.

Your query is absolutely silent as to why she went and why you and your parents (who have so far not tasted jail meals) are not interested in keeping her.
In case the reasons for not keeping her are justified then the solution may come out of these reasons only.
