Husband not paying maintenace

(Querist) 15 March 2012 This query is : Resolved 
In my case the court had given the order for maintence which is not regulary deposited by my husband and now 10 month due amount is pending. so, instead of giving maintence in advance, appro. Rs.1 lac is pending. what i can do please advice. who is responsible, court or advocate?

Please note that during my case i observe that in India so many women have to experince this during court matters. Please not that i am not favouring men or women, but it is the matter of right.

so please advice.

You should confine up to your case.

In your case, you are required to file an execution petition immediately prior to expiration of one year of order/judgment before the same court which passed the order. After receipt of notice, your husband shall directly be asked to deposit the arrears failing which his property can also be auctioned.

Dear Querist
you should filed a execution petition against your husband to recover money and approach to court to issue a attachment warrant with arresting warrant against your husband and his property, if he is unable to pay after that he can be arrest.

Apply execution, if fails to pat, property will be attached, & sold. he can be imprisoned for a month for default.
