Changing a central govt. job and joining another

dear sir,
kindly give me a suggestion.I know someone who is working i central govt. job {Indian Audit & Accounts Department (C&AG of India)} as a auditor from last 18 months and now he got another job in ONGC (oil and natural gas corporation),which he hasn't joined yet although he has got his appointment letter. Now kindly tell me whether he can resign from his present job and join his new job because a govt. employee has to sign an agreement bond to serve in his job for 5 years, moreover a govt. employee also has to obtain a NOC from his present employer for facing any interview regarding other job.
Now what legal action can be taken against that person if he resigns from his present job without informing his employer that he is joining a new job in a public sector organization ( semi govt.)& if he has not taken a permission in writing from his present department that he is going to appear an interview for a new job.
kindly let me know.

As a senior commercial clerk in the office, what concern you have with the case of the employee changing his job?
It seems,as if you want to make the experts as tool to take some of your own revenge. Let the competent authority of his organisation use his own wisdom to deal with his case.

if auditor ahs got chances of advancement in his career and got a better job with ONGC let him fight his own battles in life . if he has not followed due procedure he will suffer . dont interfere.

Let apart getting new job; I am afraid, being a central govt. employee, if he applies for another job or makes or tries to make contract for another job, he is committing a grave misconduct which entails his dismissal from the post he holds. Since he has not applied through proper channel, he is also disqualified from holding the new post also.

Mr. Venkatesh,
Can you quote any conduct rule under which his misconduct is liable to dismissal from service? Mr. Dipiankar may probably appreciate you for your help, as he also seems to get his colleague punished in similar fashion, as you stated.

He is not my colleague.. even he has no interference with my department,i work in indian railway posted in assam & he he works in accounts department in itanagar(arunachal pradesh)
even i don't envy him.All i wanted to know whether such action is legal because once i wanted to appear for Assam Civil Service examination but my application got rejected as because i mentioned that i am working in indian railway & i had not submitted a NOC from my higher authorities..

It is not understood, in what way his change of job concerns with your own case of Assam Civil Services exam?
