Settlement of my mother's undivided property to me

(Querist) 08 May 2012 This query is : Resolved
Sir/Madam,

My mother is first child to my grandfather along with 3 younger brothers. My grandfather died without making divisons to his property. my grand mother also died, now my mother wants to settle her share to me. My uncle's are not ready to give share to her. Is it possible to do settlement for me with this issue? Regarding this property issue there is a case in court filed by my mother against her brothers. if she settles her share to me, is it legally right or not and also is it possible for me to sell that to third party?

Your mother is eligible for 1/4 share in the property.
Your mother can bequeth her share in your favour by way of will. She can gift the same to you once her title on the property is clear.

Ld. Nair is right.
