Regarding claim of pocket money

(Querist) 19 May 2012 This query is : Resolved
Dear Sir,
We are having our ancesstral hotel in Meerut City(UP).This hotel was established by my grandfather in 1975. My grandfather had expired. Now this Hotel is in 50% & 50& partnership of my father & my uncle( Father's Brother). My Father is a paralytic patient and is not actively involved in Hotel Business. What my uncle and his son has done they have captured the entire Hotel as I am in service since last 12 years.
I want to ask that can I claim my pocket money of 12 years as they have not given me any income from the Hotel .Pocket Money of Rs 200 per days for a period of 12 years Amounting to Rs 7,00,000. Plz advice

Instead of claiming pocket money by you, your father must claim his 50% income due from 1975 onwards till today.

It is not a pocket money case.

As the hotel was owned by your grand father who died intestate, then your father and you should ask for a 50% claim by partition and accounting, though accounting claim survives only for 3 years due to law of limitation.

Claim of pocket money has nothing to do with the business income of your father or uncle. It is your private claim, which is dependant on the sole discretion of your father or mother.
