A civil case can be filed against the client for the loss due to C Form.

Send a debit note to client for the tax liability amount !!
If he does not issue the C Form or does not pay this balance amount, then you can file civil recovery suit.
Please ensure that you should have his TIN/CST# stated in your bill and you should be able to prove the transaction.

Every Registered Dealer buying goods on concessional rate of tax against declaration form is statutorily obliged to comply with the declaration and issue such declaration form. Failure on his part to issue is deemed to be breach of contract and attracts civil liability. He can be proceeded against for recovery of damages due to breach of conract.

You can file a suit of recovery, but the tax for the differential would need to be deposited by you first.
