Common maintanance

Respected All,
As we are living in a society which having a Ad-hoc committee and having a agreement between builder and the committee.
Builder collected Rs.15,000 lump sum amount as common area maintenance up to 31.12.2014.
But as Builder appointed a adhoc committee, he just inform to the committee to collect the maintenance and run the day to day operations. But later he also inform committee to make the payment to securities, sweeper (for common area) any other expenses incurred for common area, common area light bills, changes of electrical equipment, drainage problems etc.
Now the question is what can committee do for his negligence? He neglecting all his duties even collected one year maintenance and Rs.15,000 from each flat as common area maintenance.
60% occupancy is already done in the society. can we go for registration of society?
One of his wing internal work (lift etc.) is still pending, Can we wait for completion of work and then register the
society?
Also one question
Can we restrict any flat owner on the number of member living with them?
(For ex one of family living with 10 to 12 family members, saying they all are relatives but we are doughtful)
Request to suggest for the same.

You can call a general body meeting of all members and ask the old committee to give the account and appoint a new committee for this purpose.
