Technical resignation

Respected sir,

I was on deputation to Navodaya Vidyalaya Samiti (Central Government Organization under HRD Ministry)from Sainik School Sujanpur Tira (Autonomous body,sainik school society under Ministry of Defence)

Later on my deputation i applied for regular post of Principal in navodaya vidyalaya samiti through proper channel of sainik school department and on my selection I submitted a tecnical resignation.

On submission of technical resignation the sainik school sujanpur tira did the following deductions:

(i) 3 months salary deduction.
(ii) 50 percent deduction in mgt share of Contributory Provident Fund
(iii) 50 percent deduction in Earned Leave encashment

Please clarify that if these deductions are according to the law or rules and regulations. Kindly cite the order number and reference too.

It seems, you would not have completed the deputation period according to the terms of your deputation with the Sainik School. You may therefore need to refer to the detailed terms of deputation, as you would have received from the Navodaya Samiti while coming on deputation to the Sainik School organisation of the Ministry of Defence. In fact, even on your selection as Principal Navodaya School, you still belonged to Navodaya Samiti, as not yet absorbed in the Sainik School, as can be assumed from the partial information you supplied.

Unless you submit here the terms of your deputation as they are no proper guidance would be possible about justifications of deductions made.

Sir,
I was a lecturer in sainik school and applied through proper channel of sainik school department for the post of principal in Navodaya vidyalaya Samiti .Once selected I went on deputation and submitted a technical resignation . Hence now this case is the movement of an employee from autonomous body(sainik school society under ministry of defence ) to central govt. Organization . What Iam asking is that is such deduction are according to law or rules and regulation .

Your latest statement is contradictory to your original question. Either you don't know your position whether you are on deputation to the Sainik School or are confirmed there, Or you don't know the difference of deputation and trransfer/ posting on regular basis. You also probably do not know whether your slection, as Principal is on deputation basis or on regular basis.

About your technical resignation, you are mistaken. No technical resignation is required while going on deputation.

So, before asking the question here, you should first ensure yourself whether you were on deputation in Sainik School or on regular absorption basis. You should also ensure yourself to know whether as Principal also, you are on deputation basis or on regular absorption basis and whether your parent organisation was Sainik School or the Navodaya School, where you were serving on regular basis (NOT on deputation). Mind it, if you have not been absorbed in Sainik School on regular basis, your parent organisation was Navodaya organisation only, and you were required to apply for the post of Principal only through your parent organisation.
