If they are ready for settlement by way of mcd then go for it and get the case mutually quashed.
No point in fighting the legal battle when it cold be settled amicably.

Without seeing the FOR it is difficult to comment on its merit.
Quashing is possible if the charge sheet is submitted but change is not framed.

Dear Querist
the FIR can not be quash on this ground, basically the courts presume that the FIR is the matter of investigation and there is no strong ground to quash the FIR at this stage, you should filed an application before HC for arresting stay and should ready to co-operate investigation.
