Possession necessary to be proved only on the date of filing the suit?

(Querist) 18 July 2012 This query is : Resolved
Dear Experts,

To avoid paying the ad valorem court fee in a property suit where court fee is based on possession, is it enough to grab (unlawful) possession (when the true owner is out of station) for just the date that the suit is being filed?
Or is it necessary to be able to demonstrate settled possession for the purposes of deciding court fee?
Devajyoti Barman (Expert) 18 July 2012
Being legal professionals yu can not expect us to advise you something extra judicial.

Court fees is based on the relief prayed for in the suit.
Raj Kumar Makkad (Expert) 18 July 2012
The value shall be taken when the true owner was ousted by illegal occupants so court fee shall be calculated accordingly.
