I received one cheque which has been dishonoured. I sent legal notice to the person who issued cheque. The legal notice has been returned back as the person is not in a country... Can i file complaint under Section 138 of Negotiable Instrument Act?

No. Get the cheque dishonoured again if it in in time limit. And submit complaint. If time limit of 3 months (fter the date entered on the cheque) has passed submit complaint u/s 138 directly.

You may file complaint,if notice u/s 138 of N.I Act had been sent on correct address of drawer.
