Hi all,

My Bhabhi filed false cases of 498a,323 and 3/4 dpa . No arrest till now.
What are the steps after FIR?

concentrate your energies on fighting these case . dont file counter cases . go by your lawyers advise .

Thanks Ajay Sethi Sir,

But why there is no arrest till now.
The SHO has taken our statements and the case has gone to court as per him.

What is the next step for us?
Do we have to take bail before court case or during the court trials?

you are lucky that you didnt have to apply for anticpatory bail . engage a lawyer immediatedly . go through allegations made in FIR .

start preparing your defence on the allegations made .

try to arrive at a compromise with your bhabhi . and apply for quashing of 498 A to high court on basis of settlement

You want to know what counter you can file. This answer can be given only if facts were know.

at this stage it doe snot appear to a case ripe for charegehseet as it is seen that you are neither arrested nor on bail.

Being Govt servant you will be deemed suspended if you remain in custody for 48 hours.
