Type of property

(Querist) 20 August 2012 This query is : Resolved
Property purchased by the husband from his savings and registered in the name of his wife. This property for the wife does it become Acquired Property or Hereditary Property. Also what is the status of the property for the children when the mother is alive ?
Devajyoti Barman (Expert) 20 August 2012
This would be treated her self acquired property though this presumption can be rebutted by her legal heirs if he could prove the contrary.
K.K.Ganguly (Expert) 21 August 2012
If it was purchased after 19888, it will be considered as her self acquired property.

Had it been purchased before 1988, it could be treated as Benami purchase & the children can now demand its share calling it their father's property, if the father is deceased.
