(Querist) 16 September 2012 This query is : Resolved 
Dear Sir, My uncle had a land property in his name, he expired few years ago, leaving behind his wife & 2 married daughters. After his death, name of his legal heirs i.e his wife & 2 daughters were included in record of rights of the said plot. Subsequently they decided to sale the plot. As the 2 married daughter were staying outstation they have executed relinquishment deed in favour of their mother for the said plot, accordingly name of uncle's wife is on property card. Now, before selling the plot if uncle's wife expires, can her daughters claim their right over the said plot.

has the aunt left behind any will or she has died intestae .

if she has died intestate her daughters are her legal heirs . apply for succession certifcate

Thye were legal heirs of father. relinquished the share. But now they are legal heirs of mother. They may (or may not) relinquish.

Since daughters are the only class-I heris of the mother, they would inherit the property of their mother.
Their prior relinquishment would not stand in the way.
Here succession opens afresh.
