This query is : Resolved
Hi All,
I have transfered my case through Supreme Court in 2010 from Gujrat to Uttar Pradesh. Now I want to transfer the divorce case from Uttar Pradesh to Maharashtra. I am doing this I have seen that I will not get fair justice and I am currently in Maharastra. My query is can my case transfered second time? One more thing : I am not in UP. Working in Maharashtra. Judge giving very short date like 11 days, 15 days. Difficult for me to attend as tickets cannot book so easilly.

It will be very difficult but not impossible. If you can prove manifest injustice the transfer petition may succeed.

1) You shall have to forward acceptable reason for asking for the transfer. 2) 'Do not expect favourable judgement in U.P.' is not an acceptable reason at all.

The moment you raise this point the Court will throw your application. Cite yourother genuine reasons sans this one if you want to get transfer of your case.

in fact it is in your interest if judge gives short dates . your case would be decided soon . case was transferred to UP at your request . transfer application made by you in SC will take time to be disposed of . better take leave from your job and have case disposed of early in UP
