Crpc 161 statements

Are statements made under crpc 161 to an Investigating Officer containing wild and baseless allegations liable for *criminal* defamation u/s 499/500 of IPC?

My understanding is that there is no absolute privilege in the IPC, and as long as I can prove bad faith, I have a case. Is this correct?

When is the earliest I can file such a case?

Statements u/s/161 crpc has no relevance unless the witness affirms those statements on dock of the court.
In other cases it has no importance at all.
