Bar council rules

(Querist) 05 November 2012 This query is : Resolved 
That as per Rule 7 of Chapter III Part 6 of the Bar Council of India Rules, "a Judicial Officer after his retirement or otherwise ceasing to be in service for any reasons, if enrolled as an Advocate shall not practice in any of the Judicial, administrative Courts / Tribunals / authorities which are presided over by an officer equivalent or lower to the post which such officer last held"
Can anyone tell me what is the present status of this rule ? Heard that Karnataka High court has stayed it .. Can a President(appointed from Bar) of the Consumer Forum practice in courts upto district level after tenure as President ?

Post of President of Consumer Forum is contractual appointment for three years. After end of contract he is free to practice even in magistrate court.

Thank You. The President of Consumer Forum is appointed for a period of 5 years ,a post equal to district judge. It has been clarified in the bar council rules that it is applicable to presiding officer of all tribunals ,Consumer Forum, and other quasi judicial authorities. Hence the doubt. Rule7 &7A was introduced by Bar Council on 14.10.2007.The latest decision i came across was N.K.Bajpai V Union of India . But in this case, validity of this particular rule was not under challenge.
