Inquiry of criminal proceeding

(Querist) 03 December 2012 This query is : Resolved
If a criminal case filed against the accused, he then got the bail. Which is non-compoundable.

Can accused file qaushing of FIR in the high court without the consent of the Complainant?

Can it be done before filing of chargesheet by the police or after filing of chargesheet?
Raj Kumar Makkad (Expert) 03 December 2012
There is no requirement to take the consent of the complainant as one should not think about consent of complainant. Their is no requirement of waiting for the submission of the charge-sheet in such case before filing quashing petition before high court..
