Defamation by neighbour

(Querist) 13 January 2013 This query is : Resolved
Dear Sirs,

Our neighbour goes to our friedns, relatives and our other neighbours and defames us. He says we are mentally retarded and has defamed our character in our area. It is very difficult for us to prove these things.

Kindly advise what remedy we have in such situation.
Arvind Singh Chauhan (Expert) 13 January 2013
If your friends, relatives are ready to give evidence in court that, your neighbour, has said such to them you may succeed in defamation case

Neighbour has got no legal right to defame his neigbour so better to consult him and resolve the matter with some other restable persons failing which file criminal complaint.
prabhakar singh (Expert) 14 January 2013
None of us has right to defame any of us. Defamation is actionable cause for which remedies and relief are available on proof only.No proof no remedy in law is the situation.
